Itanagar: As ordered by the District Judge (Yupia), the office of Chief Engineer, PWD Western Zone located at Mowb-II here was on Thursday unsealed by Itanagar Capital Complex Deputy Commissioner cum District Magistrate Talo Potom – five days after it was sealed by the DM himself, following court orders for defaulting on payment to a contractor.
Earlier, the Judge, in an order, directed the Capital Complex DM to attach/seal the PWD Western Zone office in a money execution petition (No 04/2019) filed by M/s Tama Fabrication Works against the state of Arunachal Pradesh and others. The execution petition was filed by the petitioner through its Counsel J Doji for payment of an arbitral award of Rs 3,60,28,997 and interest thereof on October 21.
However, the previous order was not executed by the DM until a fresh directive came from the court on February 10 to seal the PWD WZ office immediately and submit a detailed list of properties belonging to it within one week. While speaking to the media, the DC informed that fund authorisation, including the interest, was given to the contractor by the department on February 12, the day when the CE office was sealed, but the unsealing order was received today from the court as it remained closed over the period of time.
When the Court of District Judge (Yupia) Nani Grayu took up this case on Thursday, the Counsel for the petitioner submitted that “the entire decreed amount, for which this execution petition was filed, has been paid (by Executive Engineer, PWD, Sagalee Division) by way of cheque and letter and that the same is duly received by the petitioner”.
As such, the petitioner did not want to proceed further with this execution petition (and) prayed that the plea may be closed. “In view of the above submission and prayer made by Doji, the Counsel for the petitioner, this execution petition is closed as not pressed,” today’s order from the court read. “As execution petition has been closed today being not pressed therefore, order dated 01.01.2022 and proclamation of attachment in form No.24 under order XXI, Rule 54 CPC, signed on 04.01.2022 issued from this court to Chief Engineer, Western Zone PWD, Mowb-II Itanagar and the subsequent order dated 10.02.2022 passed by this court in the execution petition directing the Deputy Commissioner -cum- District Magistrate, Capital Complex, Itanagar to comply order dated 04.01.2022 passed by this court within a week are hereby recalled and same shall stand cancelled.” “…In view of the above order passed today in the case, the entire attached and sealed property of Chief Engineer, (PWD) Western Zone, Government of Arunachal Pradesh, stand released,” it said.
