HP DGP moves SC against HP High Court order

Currently SC is on Christmas and New year vacations and matter likely to be placed in the SC on January 1 to 4 as the DGP implead the Registrar General of HP HC and others parties in the matter.

Shimla: Challenging Himachal Pradesh High Court order to shift him from the post on Friday Himachal Pradesh Director General of police Sanjay Kundu has moved in Supreme court to seek relief from the HC order of December 26.

DGP filled the special leave petition before the apex court on December 28 against the order of Himachal Pradesh High court in which division bench of Chief Justice MS Ramachandran Rao and Justice Jyotsna Rewal Dua directed the state government and secretary home to move the state DGP and Superintendent of police Kangra Shalini Agnihotri to other post before January 4, 2024.

Currently SC is on Christmas and New year vacations and matter likely to be placed in the SC on January 1 to 4 as the DGP implead the Registrar General of HP HC and others parties in the matter.

State Government was expected to take action on the High court order before the January 4 in Himachal Pradesh High court order. The advocate of the Businessmen and amicus Currie Neeraj Gupta has expressed displeasure with the progress of investigation in an FIR filed by the complaint stating that DGP remaining on this post free and fair probe could not be expected from the state police.

The DGP has moved to SC to seek relief in the matter of courts on its own motion versus State of HP case pending before the Himachal Pradesh High court.

A complaint and businessman Nishant Kumar Sharma, a resident of Palampur, Distt.Kangra, State of Himachal Pradesh had sent an email to the Registrar General of this Court on 28.10.2023 addressing the Chief Justice and court directed the registery to register the case.

High court in December 26 order stated that court was satisfied that exceptional circumstances do exist for intervening in the matter more particularly when the respondent no.1(State government) had chosen to turn a blind eye to the said material for reasons best known to it.

HC also order the state to take steps at the earliest to move the Director General of Police, HP and SP Kangra from the post, where they would not have any opportunity to influence the investigation in the FIRs referred to in this order.

Himachal Pradesh Government did not taken any action on HC order till December 30 and Goverment is expected to act on the December 26 court order soon.
