New Delhi: Supreme Court on Tuesday agreed to hear tomorrow at 3.30 pm the Shiv Sena Uddhav Thackeray-faction’s plea challenging the ECI’s order giving the party name and ‘Bow and Arrow’ symbol to Eknath Shinde faction, recognising them as real Shiv Sena.
“We will hear the matter tomorrow,” the Supreme Court bench, headed by the Chief Justice of India (CJI) Dr Dhananjaya Yeshwant Chadrachud said.
Senior advocate, Kapil Sibal, appearing for Uddhav Thackeray faction, sought Supreme Court’s order and urgent stay of the Election Commission of India (ECI) order saying the other side has taken over Sena office in Assembly and would soon take over the party bank account.
The other party, Eknath Shinde-faction counsel, Neeraj Kishan Kaul told the Supreme Court that it should not hear this plea and send them to Bombay High Court.
Sibal pressed for a hearing late today afternoon. But the bench headed by the CJI Dr Chandrachud, said the judges need to read the Special Leave Petition (SLP) filed by Thackeray faction. So, what can we do is that we will hear the case tomorrow.
Shinde group has filed a caveat to prevent any ex-parte order by the court.
The Election Commission of India (ECI) in its order on February 17, Friday, had decided that Maharashtra CM Eknath Shinde’s faction is the real Shiv Sena, and gave the original name and symbol to his faction.
Challenging this ECI’s order, Uddhav Thackeray faction had moved the Supreme Court yesterday.
