New Delhi: The Supreme Court on Tuesday ordered the demolition of the 40-storeyed twin towers in Supertech’s Emerald Court project in Noida, upholding an order by Allahabad High Court for violation of building norms.
The order came on petitions by Supertech and others including home buyers against the Allahabad High Court’s 2014 verdict directing the demolition of the twin towers.
The Supreme Court directed that the demolition has to be carried out within three months.
The demolition will be monitored by the Noida authority and will be carried out by an expert agency. The cost will be borne by Supertech Ltd, the construction company of the project. The towers have over 900 flats and shops.
The apex court bench also ordered that payments made by home buyers should be refunded with 12 per cent interest from the time of the booking and the Residents Welfare Association be paid Rs 2 crore for the harassment caused by the builder.
Justice DY Chandrachud, reading the order, said the record of the case is replete with instances that show an ”unholy nexus” of the Noida authority with the builder.
In April 2014, the Allahabad High Court had ordered the demolition of the two buildings within four months and refund of the money to apartment buyers.
