Mention of Sikkimese Nepali community as ‘Foreigners’ needs to be expunged: Tamang

Gangtok: The Chief Minister of Sikkim, PS Tamang has expressed concern over Sikkimese Nepali (s) being referred to as ‘Foreigners’ in the recent judgement of the Supreme Court on IT exemption.

“State Govt has initiated steps to approach the apex court to expunge the mention of Sikkimese Nepali community as foreigners.No stone would be left unturned to address this issue. Article 137 of the Constitution of India grants the Supreme Court of India, the power to review any of its judgement orders, subject to conditions,” said Tamang at an SKM state executive committee meet convened to discuss the issue.

He was speaking about the Supreme Court’s Judgement dated January ’23, in the case of the Association of Old Settlers of Sikkim and others V/S Union of India.

‘He welcomed the Judgement, wherein old Settlers of Sikkim have been exempted from Income Tax.

But he expressed deep concern over some pages, of the judgment which, appear to suggest that Nepalis were migrants and persons of foreign origin, settled in Sikkim. Subsequent to ‘ Application for Amendment of the Writ Petition’ filed by the petitioners, dated 31.7.13.and also allowed by the Supreme Court, vide order dated 2.8.13.all such words were deleted from the original petition. But,it appears that the amended petition has been erroneously overlooked while dictating the judgement. Therefore, it has been decided to explore the possibility of filing of a review petition for it,’ informed, Jacob Khaling Political Secretary to CM.

Khaling, stated “there have been false and unfounded allegations that the State Govt has remained silent on the issue, we as responsible and mature Govt, who endeavour to do best for all the Sikkimese,without making noise.
