SC okays AIADMK to amend party bye-laws

New Delhi: The Supreme Court on Wednesday stayed a June 23 Madras High Court Division Bench order restraining the AIADMK General Council from amending the party bye-laws.

A two-judge vacation Bench headed by Justice Dinesh Maheshwari and also comprising Justice Krishna Murari passed the interim order.

The court also issued notice to the O Paneerselvam camp on a plea of former Chief Minister Edappadi Palaniswamy against the Madras High Court order. It clarified that the General Council meeting on July 11 will take place.

The Palaniswamy group had moved to the Supreme Court challenging the order of the Madras High Court which put a stay on the proceedings of the internal working mechanism of the AIADMK.

“We do not consider it necessary to pass any other order at this stage. Pendency of proceeding before this court shall not affect any other proceeding before the single judge bench,” the Supreme Court said.

The Bench also issued notice to the Paneerselvam camp returnable in two weeks. “The order of the division bench of June 23 shall remain stayed till further orders of this court,” it said.

The meeting of the General Council slated on July 11 will go on, it said.
Senior lawyer C S Vaidyanathan, appearing for Palaniswamy, told the Supreme Court that a contempt petition for violation of the order of the division bench is listed for Thursday. The High Court has a very limited say in the internal management of a voluntary organization, he said.
