Myanmar Army deserter gets 10 years jail in Mizoram

The Judge exonerated Aung on charges against him under section 14 A(b) of the Foreigners’ Act as he entered Mizoram for fear of persecution, though without any valid travel documents.

Aizawl: A Champhai district court in Mizoram has sentenced a Myanmar Army deserter to ten years imprisonment in the attempt to murder case and causing grievous injuries to two persons.

Additional District and Session Judge of Champhai judicial district Sylvie Zomuanpuii Ralte on Monday found Min Aung guilty of causing grievous hurt to Lalmuanpuia and Malsawmsangi and also for attempting to kill them which is punishable under section 326 IPC and 307 IPC respectively. 

The judge accordingly convicted Min Aung under sections 326 and 307 IPC.

Ralte pronounced the Order on sentencing the Army Deserter on Tuesday afternoon.

Min Aung was sentenced on his conviction under Section 307 of IPC, to undergo simple Imprisonment for a period of 7 years and to pay a fine of Rs. 2000.  

In default of payment of the fine, he shall further undergo Simple Imprisonment for 2 months. 

On his conviction under section 326 IPC the accused is sentenced to undergo simple Imprisonment for a period of 3 years and to pay a fine of Rs. 1000. In default of payment of the fine, he shall further undergo Simple Imprisonment for 1 month,” the judge said.

The period of sentence shall run consecutively. The Judge exonerated Aung on charges against him under section 14 A(b) of Foreigners’ Act as he entered Mizoram for fear of persecution, though without any valid travel documents.

The prosecution said that Min Aung S/o Tin Teing, resident of Makui, Myanmar, being lodged at ITI Building, Zote Refugee Camp in Champhai district is a deserter from the Myanmar army who reached the Refugee Camp at Zote on August 30, 2022.

On September 3, 2022 in between 10 PM – 11:00 PM Aung went to the room of Lalmuanpuia, which is also part of Refugee Camp. He asked Lalmuanpuia and his wife Malsawmsangi to buy liquor for him to which they refused and also informed him that taking liquor inside the Refugee Camp was prohibited. On hearing this he became angry, took out his Machete and with it he hit both the knees of Lalmuanpuia and also did the same to his wife Malsawmsangi at the nape of her neck.

Robert Zoremtluanga, chairman of the Committee on Myanmar Refugees at Champhai filed a complaint against the absconding Min Aung on September 4, 2022.

Aung was nabbed on the same day by members of the Young Mizo Association (YMA) of Hmunhmeltha village while hiding in a farm hut along with the ‘Mizo Chempui’ (machete) he used for committing the crime.
