Imphal: The Manipur High Court in its order of October 12 has rejected the application of Karam Shyam against the Election Petition No. 7 of 2022 filed by O Joy and ordered for trial of the election petition for a final decision to ascertain whether the election of Karam Shyam is void or not.
Okram Joy Singh had filed an Election Petition No. 7 of 2022 challenging the Election of Karam Shyam who was elected from 20-Langthbal Assembly Constituency in the 12th Manipur Legislative Assembly Election, 2022 on various grounds one of the major grounds is that Shri Karam Shyam Singh has make false statement in the Form 26- Affidavit submitted along with the nomination paper so far has his educational qualification is concerned. In the case it is pleaded that Shri Karam Shyam had passed Bachelor in Textile Technology, however, in the Form-26 Affidavit submitted along with his nomination paper, he stated that he has passed Bachelor in Textile Engineering.
As per the petition such false declaration amounts to betraying the Electorate of 20-Langthabal Assembly Constituency. And the said Election Petition was taken up by the Acting Chief Justice of Manipur High Court.
Shri Karam Shyam has filed an application, MC (El. Pet.) No. 9 of 2022 for rejecting Election Petition No. 7 of 2022 on the grounds that the said Election Petition has failed to disclose the actual cause of action while filing the same. The Miscellaneous Application was taken up for hearing and after hearing the ld. Counsels of the parties the order was reserved by the Manipur High Court on August 27, 2023 and the Court was pleased to announce the judgment on October 12, 2023, thereby rejecting the application of Karam Shyam and the Court has ordered for trial of the Election Petition for a final decision to ascertain as to whether the Election of Shri Karam Shyam is void or not.
